A DWAI (Driving While Ability Impaired) occurs if the blood alcohol content of the driver is between 0.05% and 0.08%. A first time offended can face imprisonment for up to 15 days, and the minimum fine is anywhere from $300 – $500. Furthermore, a conviction can result in the suspension of driving privileges for 90 days.
A DWI (Driving While Intoxicated) is considered 0.08% BAC, and is more serious than a DWAI. Driving privileges could be suspended for a minimum of 6 months. The minimum fine is $500, ranging all the way up to $1000, not including any applicable fees. The most extreme will face imprisonment for up to a year.
An Aggravated DWI is the newest and most extreme of the DWI laws. A person can be accused with an Aggravated DWI when they operate a vehicle with a BAC of 0.18% or higher.
